Spartech, LLC (“we,” “us,” “our,” or “Spartech”) knows your privacy is important. We prepared this Privacy Policy to describe our information practices and, in particular, how we collect, use and share Personal Information, as defined below. Scope

This Privacy Policy applies to the information we collect through websites and brands owned and operated by Spartech that link to this Privacy Policy, and to consumers whose information Spartech, our brands, and the websites who link to this Privacy Policy process online and offline. Throughout this Policy, we refer to our websites and your other interactions with us as a consumer as the “Services.” This Privacy Policy does not apply to employees or job applicants of Spartech.

PERSONAL INFORMATION

When we use the term “Personal Information” in this Policy, we mean any information that is linked or can be reasonably linked to an identified or identifiable person. For example, this includes your name, home address, Internet Protocol (IP) address, or other unique identifier that can be linked to you.

Personal Information does not include “aggregated information,” which is information that we collect about a group or category of persons or services. It also does not include “de-identified information,” which is information from which we or our agents have removed identifiers that can be used to specifically identify a person, either directly or indirectly. This Privacy Policy does not apply to our collection, use, or disclosure of aggregated or de-identified information.

Personal Information Collection

We collect Personal Information in three ways: (1) when you provide it to us (or a third party acting on our behalf), (2) automatically when you visit our website, and (3) from other third parties.

We collect the following categories of Personal Information from individuals who interact with or use our Services, and have collected the following categories of Personal Information from individuals in the last twelve months:

  • Identifiers, such as your name, contact information, address, telephone number, and online or unique device identifiers.
  • Commercial information, such as records of products or services purchased, billing details, and information about previous transactions.

  • Internet or other similar network activity, such as information about your interactions with our Services or advertisements.
  • Geolocation data, such as the physical location of you or your device that accesses our Services.
  • Audio, electronic, visual, or similar information, when we collect audio recordings of sales and service calls to enhance and improve our Services.
  • Professional or employment-related information, including the organization you are associated with us when you contact us to purchase or inquire about our products, or to distribute to us raw materials we use to make our products.
  • Inferences we derive from the information that we collect to create profiles reflecting your preferences, characteristics, trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes.

  • Device information and unique device identifiers, such as your IP address.

The types of information we collect from you depends on your reason for interacting with us. For example, we may not collect the same information from website visitors that we do from individuals who visit our booth at tradeshows or from sales leads, or from our distribution contacts. As such, we may not collect all of the categories of information listed above from every individual who interacts with us.

How We Use Your Personal Information

We process your Personal Information with your consent, to perform our contractual obligations, to provide Services to you, where it is in our legitimate interest to process such information, and where we have a legal obligation to do so.

We may use the Personal Information we collect about you for the following business purposes:

  • Provide you with Services you request from us, including to fulfill your orders or purchases, and to provide and operate our websites.
  • Communicate with you when you request information or assistance from us, and about our Services or products you purchase from us.
  • Market our products and Services to you, and understand the effectiveness of our marketing communications.

We may aggregate, pseudonymize, or de-identify the Personal Information we collect and create reports that do not personally identify individuals.

The legitimate interests we pursue include marketing our products to you, improving our products and services, improving our business, providing continuity of services in the event of a change of control, personalizing your experience, identifying trends, and enforcing our Terms of Use and other agreements.

Combination of Information

We may combine the Personal Information we receive from or about you from one source with Personal Information we receive from or about you from other sources, or across multiple interactions with you. For example, we may combine the information we receive directly from you that you provide to us, with information that we collect from you automatically when you visit the website, or that we collect from a third party about you.

How We Disclose Your Personal Information

We disclose Personal Information for a business purpose to the categories of third parties and for the purposes outlined below. In the last twelve months, we have disclosed all of the above categories of Personal Information that we collect with some or all of the below categories of third parties:

  • Corporate affiliates, to provide and maintain our Services, and for administrative purposes.
  • Service providers, contractors, and vendors who perform functions on our behalf, which include but are not limited to service scheduling, website hosting, marketing automation, analytics, site optimization, and payment processing. In some circumstances, the service provider may collect data directly from you.
  • Successors in interest, if we sell all or part of our business, make a sale or transfer of assets, or are otherwise involved in a merger, restructuring or business transfer, including as part of the due diligence and transaction process, the Personal Information we collected about you may be part of the transfer.

Cookies and Automatic Data Collection

We use various technologies to automatically collect unique device identifiers such as your IP address, browsing history, the operating system you use, and information about your general location. The categories of information we collect automatically that may be considered Personal Information include unique device identifiers, geolocation data, internet or other similar network activity, and information about your preferences (for example, the time zone that you access the website from).

We collect information from you automatically using cookies and other similar technology. Cookies are small data files that are stored by a user’s web browser on the user’s hard drive. Logging Functionality: As is true of most websites, we gather certain information automatically and store it in log files. We generally only use this data for purposes such as security, fraud detection, and protecting our rights.

Cookies and Other Data Collection Technologies: We and third parties we work with use cookies, web beacons, and similar technologies to manage our websites and email messages and to collect and track information about you and your activities online over time and across different websites. In addition, we use local shared objects (or Flash cookies) to collect and store information about your preferences and how you interact with the websites. Location Information: We may collect location information through our websites so we can offer you certain location-based services (such as delivering advertisements that are relevant to your particular location, and conducting analytics to improve the website).

Depending on browser type, your browser may inform you that our websites would like to collect your location and request your permission to do so. If you allow it, location information is then collected and may be stored locally on your device. If you decline the collection of location information, your location is not collected, and you must manually enter your location.

Sales and Sharing of Personal Information and Use of Personal Information for Online Advertising

Spartech does not sell Personal Information for money, but in the last twelve months, we have shared Personal Information including identifiers, commercial information, internet or similar network activity, inferences, geolocation data, and unique device identifiers with providers of advertising and analytics services, network advertisers, social media companies, and partners who assist us with target audience creation. This sharing and disclosure is considered a “sale” of or the “sharing” of Personal Information for the purpose of targeted advertising under some state laws.

If you are a resident of certain jurisdictions, you have the right to opt-out of the sale and sharing of your Personal Information to third parties for these purposes, and to limit our use of your Personal Information for targeted advertising. Our websites may contain hyperlinks or embedded links to websites operated by third parties. Some links may take you to third-party websites containing information that may be useful or of interest to you.

We do not control how your Personal Information is collected through third-party websites or the software used to collect it, nor do we control the security implemented by the third party that controls any third-party website. All third-party websites are operated independently from us. You understand and agree that, when you follow a link to a third-party website, this Privacy Policy and the practices that we follow under this Privacy Policy cease to apply. Rather, the third-party website’s privacy policy will apply to the Personal Information you provide through that third-party website. We are not responsible for the content, accuracy, or opinions expressed on any third-party website or for the privacy practices of any third party. We will not, and are under no obligation to, investigate, monitor, or check the third-party website for accuracy or completeness, or for any obscene, scandalous, inflammatory, pornographic, indecent, profane, defamatory, or unlawful content or materials. Inclusion of any link to a third-party website does not imply approval or endorsement of the third-party website.

Information Retention and Security

We retain your Personal Information for the period necessary to fulfill the purpose(s) for which it was collected, as described above in this Privacy Policy, unless a longer retention period is required by law or is necessary to fulfill our legal obligations.

We have put in place reasonable physical, electronic, technical, and managerial procedures to safeguard and secure Personal Information from unauthorized use or disclosure. Due to the open communication nature of the Internet, however, we cannot guarantee your Personal Information will be 100% secure and free from accidental or unauthorized use, disclosure, or access. International Data Transfers

Spartech is proud to serve the global marketplace. For individuals who access and use our the Services and who reside outside of the United States, including in Canada, your Personal Information will be processed in the United States, where our servers and operations are located. The data protection laws of the United States may differ from the laws in your country of residence and afford a different level of protection. When you use our websites, we rely on your consent to process your Personal Information in the United States. When you request or purchase products from us, we transfer data necessary to perform the contract for goods and services between you or your organization and Spartech, or to implement pre-contractual measures at your or your organization’s request. When you use or interact with our Services, your information is processed in accordance with this Privacy Policy.

For residents of the European Economic Area (“EEA”) some countries outside the EEA are recognized by the European Commission as providing an adequate level of data protection (the full list of these countries is available here). For data transfers from the EEA to countries not considered adequate by the European Commission, we endeavor to ensure that adequate measures are in place, including by ensuring that the recipient is bound by the European Union’s Standard Contractual Clauses or by another method which has been approved by the European Commission, or by an applicable transfer framework approved by UK and/or Swiss regulators, as applicable, or that other safeguards are in place to provide an appropriate level of protection to the data that is processed.

If you reside outside of the United States and move forward with using or interacting with Spartech’s Services, you, in accordance with our Terms of Use, consent to the transfer of personal information to the United States.

Children Under the Age of 13

This website is provided for and targeted to adults and is not intended to be used by children under thirteen (13) years of age. We do not knowingly collect Personal Information from children under the age of thirteen (13). If you believe we have been provided Personal Information from or about a child under thirteen (13) through this website, please contact us at the email below. If we have stored any such Personal Information in our database, we will delete it as soon as reasonably practicable after receiving notice from you.

Your Rights and Choices

You may also have the right to request that we transfer your information to another organization, under certain circumstances.

California’s Shine the Light Law

California’s “Shine the Light” law, Cal. Civ. Code § 1798.83, entitles California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. If you are a California resident, you may have the right to request information about Spartech’s practices under this statute. Any inquiries regarding Personal Information sharing with third parties may be directed to us at the contact information set forth below.

Right to Deletion or Right to Erasure

You may have the right to request that we delete any of the Personal Information that we collect or retain about you, subject to certain exceptions. After we receive and verify your request, we will delete (and direct any of our service providers that hold your Personal Information on our behalf to delete) your Personal Information from our records, unless an exception applies. We may deny your deletion request if retaining your Personal Information is necessary for us or our service providers, as permitted by law.

Right to Opt Out of the Sale or Sharing of Personal Information, or the Use of Personal Information for Targeted Advertising

You may have the right to opt out of the sale or sharing of your Personal Information. Right to Withdraw Consent

Right to Appeal

If you are a resident of certain jurisdictions, you have the right to file an appeal with us if we deny your request to exercise your rights. Requests to appeal can be communicated through the same means by which your request was submitted. If we deny your appeal, you may have the right to appeal to your state regulator. We will provide you the information of the applicable regulator if we deny your appeal.

Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your Personal Information. You may also make a verifiable consumer request on behalf of your minor child.

You may only make a verifiable consumer request for access or data portability twice within a twelve-month period. The verifiable consumer request must:

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected Personal Information or an authorized representative.
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We will take steps to verify your consumer request, including that you are the person making the request, or you have authority to make the request on behalf of the individual the request relates to. We cannot respond to your request or provide you with Personal Information if we cannot verify your identity or authority to make the request and confirm the Personal Information relates to you. Making a verifiable consumer request does not require you to create an account with us. We will only use Personal Information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.

Response Timing and Format

We endeavor to respond to verifiable consumer requests within 45 days of receipt. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing. We will deliver our written response by mail or electronically, at your option. Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request’s receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your Personal Information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

Non-Discrimination

We will not discriminate against you for exercising any rights you have under applicable law. Unless permitted by applicable law, we will not:

  • Deny you goods or services.
  • Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.
  • Provide you a different level or quality of goods or services.
  • Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

However, we may offer you certain financial incentives permitted by state law that can result in different prices, rates, or quality levels. Any permitted financial incentive we offer will reasonably relate to your Personal Information’s value and contain written terms that describe the program’s material aspects. Participation in a financial incentive program requires your prior opt in consent, which you may revoke at any time.
